After more than five years of fighting it, Uber finally gives in.
After more than five years of fighting it, Uber finally gives in and settles lawsuit with its drivers over employment status. According to NY Times article, Uber will pay the Plaintiff drivers $20 Million.
For as long as the ridesharing companies have been in operation, Uber and Lyft have continually pushed the narrative that their drivers are not employees. They do so to attempt to limit their own responsibility for the actions of their drivers, and limit their driver’s employment rights.
Uber and Lyft both claim to do “extensive background checks” when hiring drivers but they simply don’t. Instead, they are completely dependent on rating and reporting from passengers to evaluate their own. Often, these reports come after an incident of a driver’s reckless or abusive behavior or driving.
At the same time, neither Uber nor Lyft provide their customers options to choose drivers. Instead, they continue to take the position that they need to control who drives their customers, while not being responsible for those drivers’ actions.
As noted in previous posts, when Uber accidents or Lyft accidents happen, injury claims can be substantially more complex than in regular car accident cases. Uber and Lyft claims are often handled by more aggressive third party adjusters and attorneys.
However, this doesn’t mean that an accident victim is left without recourse. These companies have shown a strong willingness to settle early for a favorable amount, as long as the injured party presents the claim in a specific manner.
